Tripod Labs – Terms and Conditions

1. Acceptance of Terms
These Terms and Conditions (the “Terms”) are a legally binding agreement between you (“you” or “User”) and Tripod Labs, Inc. (“Tripod Labs,” “Company,” “we,” or “us”). These Terms govern your access to and use of our website and mobile application, including all content, functionality, and services offered therein (collectively, the “Services”). By accessing, downloading, or using our Services (or by clicking “I Agree” or similar when prompted), you acknowledge that you have read and understood these Terms and agree to be bound by them. IF YOU DO NOT AGREE to these Terms, you must not access or use the Services.
We are committed to protecting your privacy. Please review our Privacy Policy (available via our website or app), which describes how we collect, use, and share your information. The Privacy Policy is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as outlined in the Privacy Policy.
2. Description of Services
Tripod Labs provides an informational website and a companion mobile application designed to help individuals address and manage problem gambling behavior. Our Services include educational content, self-help tools, and resources intended to support safer gambling practices, gambling reduction, or cessation strategies. The Services may offer personalized features (such as interactive exercises, goal tracking, and daily check-ins) to guide users in making positive changes in their gambling habits.
Please note that while the Services aim to support your well-being, Tripod Labs is not a healthcare or addiction treatment provider. The content and tools we provide are for informational and support purposes only and are not intended as professional advice or therapy (see Section 8 below for more on this important disclaimer). The mobile app portion of our Services is offered on a subscription basis (see Section 5 on Subscriptions and Fees), and a paid subscription is required to unlock full access to all features and content. Some information or limited features may be available for free on our website or as a preview in the app, but continued use of the core program will require an active paid plan.
3. Eligibility
The Services are intended for use by adults in the United States. By using the website or app, you represent and warrant that:
You are at least 18 years of age (or older where the age of majority is above 18 in your jurisdiction). Persons under 18 are strictly prohibited from registering an account or using the Services.
You reside in the United States and are accessing the Services from within the U.S. The Services are not intended for use by those outside the United States, and we make no representations that the Services are appropriate or available in other locations.
If you do not meet these eligibility requirements, you must not access or use the Services. We reserve the right to refuse access to any person or jurisdiction at our discretion, including if we learn you are under 18 or located outside the U.S.
4. Account Registration and User Information
To access certain features of the Services (including the mobile app content), you will need to create an account with Tripod Labs. When registering, you will be required to provide information such as your full name and a valid email address. You agree to provide accurate, current, and complete information during sign-up and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials (e.g. password) and for all activities that occur under your account.
Account Security: You must not share your login credentials with others or use another user’s account. If you suspect any unauthorized access to or use of your account, you agree to notify us immediately via our Contact Information in Section 14. Tripod Labs is not liable for any loss or damage arising from your failure to safeguard your account information or from unauthorized access to your account.
By creating an account, you consent to our collection and use of your personal information (such as name, phone number, and email) as described in our Privacy Policy. We may use your phone number and/or email to send you service-related communications, push notifications, account confirmations, and, where permitted, promotional messages (you can opt out of marketing notifications as described in the Privacy Policy).
5. Subscription and Fees
Paid Subscription Requirement: The Tripod Labs mobile app is provided on a paid subscription basis. Upon creating an account or after any free trial period (if offered), you will be required to select a subscription plan and provide a valid payment method. Subscription options may include, for example, a monthly or annual plan, and will automatically renew at the end of each subscription term unless you cancel beforehand. By subscribing, you authorize us (or our third-party payment processor) to charge your provided payment method for the recurring subscription fees, plus any applicable taxes, on each renewal date until you cancel.
Billing and Cancellation: All fees are stated in U.S. dollars and are exclusive of applicable taxes. You are responsible for paying any such taxes. Subscription charges will be billed to your selected payment method on a recurring basis in accordance with the plan you choose. You may cancel your subscription at any time by following the instructions in the app settings or contacting our support (see Section 14). If you cancel, you will continue to have access to the paid features until the end of your current billing period, and no prorated refunds will be provided for the remaining period of a subscription unless required by law or explicitly stated in a promotional offer. It is your responsibility to cancel your subscription before renewal if you do not wish to be charged.
We reserve the right to change our subscription plans or adjust pricing for our Services at any time. Any price changes or modifications to subscription plans will be communicated to you in advance (for example, via email or in-app notification) and will become effective at the start of the next billing cycle. If you do not agree to a price change, you may cancel your subscription before the change takes effect. Continued use of the Services after the price change constitutes your acceptance of the new fees.
6. License to Use the Services
Limited License: Subject to your compliance with these Terms and ongoing payment of any required subscription fees, Tripod Labs grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. This license is provided solely for you to utilize and receive the intended benefits of the Services as permitted by these Terms.
All rights not expressly granted to you in these Terms are reserved by Tripod Labs and its licensors. You acknowledge that the Services and all content provided through the Services (including but not limited to text, graphics, software, and design elements) are the intellectual property of Tripod Labs or its content providers, protected by copyright, trademark, and other applicable laws. You agree not to copy, reproduce, modify, distribute, create derivative works from, publicly display, or publicly perform any portion of the Services or content without our prior written consent, except as expressly allowed under these Terms.
No Right to Resell or Commercial Use: You may not use the Services or any content for any commercial purpose or for the benefit of any third party. This means you cannot sell, resell, license, rent, or exploit our Services or content in any way not authorized by us. Additionally, you may not reverse engineer, decompile, or attempt to extract the source code of any software or databases from our website or app, except to the extent such restriction is prohibited by law. Any unauthorized use of the Services or content will result in the immediate termination of the license granted herein (see Section 11) and may violate applicable law.
7. User Responsibilities and Acceptable Use
By using Tripod Labs, you agree to use the Services responsibly and only for their intended purposes. You are solely responsible for your conduct while accessing our website or app. As a condition of using the Services, you agree that you will NOT:
Violate Laws or Regulations: Use the Services for any unlawful, illegal, fraudulent, or unauthorized purpose. You agree to comply with all applicable federal, state, and local laws and regulations while using our Services.
Misuse the Platform: Submit or transmit any content that is defamatory, obscene, pornographic, vulgar, violent, harassing, hateful, or otherwise objectionable or inappropriate, as determined by us in our sole discretion. This includes any content that promotes illegal activities or gambling behavior that violates the law.
Infringe Rights: Upload, post, or transmit any content that infringes or violates the intellectual property rights, privacy rights, or any other rights of any person or entity. You must not attempt to impersonate any person or entity or misrepresent your affiliation with any person or entity.
Interfere with the Services: Engage in any activity that could disrupt, damage, overburden, or impair the functioning of our website, app, or servers. This includes introducing viruses, worms, malware, or any other harmful code. You also agree not to attempt to gain unauthorized access to any part of the Services (including other users’ accounts, data, or systems) or bypass any measures we use to restrict access or protect our Services.
Data Mining or Scraping: Use any robot, spider, crawler, scraper, or other automated means or interface not provided by us to access the Services or to extract data. You may not frame or mirror any part of the Services without our prior written consent.
Commercial Solicitation or Spam: Use the Services to advertise or promote any product, service, pyramid scheme, or other venture not authorized by Tripod Labs. You agree not to send any unsolicited or unauthorized advertising, solicitations, promotional materials, junk mail, spam, or chain letters through the Services.
We reserve the right (but have no obligation) to monitor user activity and content on the Services to ensure compliance with these Terms. We may investigate and take appropriate action against anyone who, in our judgment, violates these rules, including removing offending content, suspending or terminating accounts (see Section 11), and/or reporting such conduct to law enforcement authorities.
You are responsible for any content (such as feedback, comments, or other information) that you submit or share through the Services. By submitting any content, you grant Tripod Labs a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display that content for the operation and improvement of the Services. You represent that you have all necessary rights to any content you provide and that sharing such content does not violate any third-party rights or laws.
8. Medical Disclaimer (No Medical Advice or HIPAA Coverage)
NOT MEDICAL OR THERAPEUTIC ADVICE: Tripod Labs is not a medical, psychological, financial, legal, or gambling addiction treatment provider. The Services (including any information, quizzes, articles, suggestions, notifications, or interactive chat features) are for educational and self-help purposes only. Nothing on our website or app constitutes or should be construed as professional medical advice, diagnosis, or treatment. You should NOT rely on the Services as a substitute for professional healthcare advice or formal treatment for gambling addiction or any other mental health condition. If you have concerns about your gambling behavior, mental health, or any medical condition, you should seek advice from a qualified professional (such as a licensed counselor, doctor, or mental health provider). Never disregard professional medical advice or delay seeking treatment based on information you obtained through Tripod Labs.
NO EMERGENCY SERVICES: The Services are not intended for crisis or emergency situations. We do not offer crisis intervention or emergency support. If you believe you are a danger to yourself or others, or if you are experiencing a medical or psychiatric emergency (for example, feeling suicidal or experiencing acute distress), please call 911 or the relevant emergency number in your area, or seek immediate assistance from emergency services or a hospital. If you are facing serious issues related to gambling addiction, consider contacting the National Problem Gambling Helpline (1-800-522-4700) or a similar professional resource for immediate help. Tripod Labs cannot and does not provide emergency or real-time intervention services.
NOT HIPAA-COMPLIANT: Tripod Labs is not a “covered entity” under the U.S. Health Insurance Portability and Accountability Act of 1996 (HIPAA), and our Services are NOT HIPAA-compliant. This means the information you provide to us is not protected under HIPAA and related health privacy laws in the same manner as it would be if you were providing it to a healthcare provider or a covered health entity. While we take reasonable measures to protect your privacy and secure your data (as described in our Privacy Policy), we do not guarantee the same level of confidentiality or security as a medical professional or HIPAA-regulated entity. Do not share any information with us that you consider to be protected health information or that you are not comfortable disclosing under these conditions. By using the Services, you acknowledge and accept that any data you provide is subject to our Privacy Policy and not to HIPAA or other medical privacy regulations.
No Doctor-Patient Relationship: Your use of the Services does not establish any kind of therapist-patient, doctor-patient, or any fiduciary relationship between you and Tripod Labs. We do not monitor your personal situation or well-being, and communication with Tripod Labs (including any support emails or in-app messages) does not create a confidential or privileged relationship. All use of the Services is at your own risk. You assume full responsibility for any decisions or actions taken based on information obtained through the Services. Tripod Labs and its team expressly disclaim any and all liability for any harm, injury, or loss that may result from use of the Services or reliance on the information provided. (See also Section 10 on Limitation of Liability.)
9. Disclaimer of Warranties
Tripod Labs provides the Services on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, regarding the Services and all content therein. This includes, but is not limited to: implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties that may arise from course of dealing or usage of trade. We make no guarantee that:
The Services will meet your requirements or achieve any particular results. (For example, we do not guarantee that use of our app will lead to any specific outcomes in your gambling behavior or mental health.)
The Services will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. While we strive for high availability and will address issues that arise, we cannot promise the platform will be free from downtime or technical problems.
The information or content provided (whether by Tripod Labs or by users) is accurate, complete, or reliable. We are not liable for any errors or omissions in content, and any reliance you place on such information is at your own discretion and risk.
Use at Your Own Risk: You understand that participation in any activities suggested by the Services (such as self-assessment quizzes, budgeting tools, or behavioral exercises) is voluntary and at your own risk. We do not warrant that the Services are safe or appropriate for every user. You assume all risk for any decisions made or actions taken based on information obtained from the Services.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not apply to you. In such case, any mandatory warranties required by law will apply only to the minimum extent required for such jurisdiction.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL Tripod Labs OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AFFILIATES, OR LICENSORS (THE “Tripod Labs PARTIES”) BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, arising out of or in connection with your use of (or inability to use) the Services or any content therein. This limitation of liability applies to all types of claims, whether based in contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages. This means that, to the extent allowed by law, the Tripod Labs Parties will not be responsible for things like: lost profits or revenues, financial losses, loss of data, loss of goodwill, damage to reputation, or any personal injury or emotional distress that may result from using our Services or from unauthorized access to or alteration of your transmissions or data.
In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability will be limited to the fullest extent permitted by law.
Cap on Liability: Except where prohibited by law, the total cumulative liability of the Tripod Labs Parties to you for all claims related to or arising from the use of the Services (including any cause of action sounding in contract, warranty, tort, or strict liability) shall not exceed the amount (if any) you paid to Tripod Labs in subscription fees in the twelve (12) months immediately preceding the event giving rise to the liability. If you have not paid any amount to us (for example, if you only used free portions of the Services), the Tripod Labs Parties’ total liability to you shall not exceed US $100. This limitation is aggregate and not per-claim.
User’s Responsibility for Actions: You agree that Tripod Labs is not liable for any actions you take or decisions you make in reliance on the information or advice obtained through the Services. You fully release the Tripod Labs Parties from any claims or liability arising from your use of the Services or from any third-party content or services that may be accessed via our platform. If you have a dispute with a third party (for example, other users, or an external service or advertiser found through Tripod Labs), you release the Tripod Labs Parties from any and all claims, demands, and damages arising out of or in connection with such dispute.
The limitations in this Section 10 are a fundamental part of the agreement between you and us. You acknowledge that Tripod Labs would not be able to provide the Services on an economically feasible basis without such limitations, and that if you do not agree to these limitations of liability, you should not use the Services.
11. Termination and Suspension
Termination by Tripod Labs: We reserve the right, in our sole discretion, to suspend or terminate your account or your access to all or part of the Services at any time with or without notice and with or without cause. For example, we may suspend/terminate your use if we believe you have violated these Terms, if you fail to pay required subscription fees, or if we discontinue the Services. We will not be liable to you or any third party for any termination of your access to the Services. If we terminate your account due to a violation of these Terms or illegal conduct, we are under no obligation to refund any fees you may have paid.
Your Right to Terminate: You are free to stop using the Services at any time. You may delete your account or uninstall the app if you no longer wish to use Tripod Labs. Termination of your account will not relieve you of any obligation to pay any accrued fees or charges (if applicable) or negate any liability you may have incurred under these Terms. If you terminate a subscription, such termination will be effective at the end of your current billing period, as described in Section 5.
Effect of Termination: Upon any termination of these Terms (whether by you or by us), the rights and licenses granted to you will immediately end, and you must cease all use of the Services and delete any copies of our app or materials obtained through the Services in your possession. However, any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to provisions related to ownership of intellectual property, disclaimers of warranties, limitations of liability, dispute resolution, and governing law. Termination of your access or account shall not affect any rights or remedies which have accrued up to the date of termination.
12. Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to the Services or these Terms shall be governed by and construed in accordance with the laws of the United States and, to the extent not inconsistent with or preempted by federal law, the laws of the State of Wyoming without regard to its conflict of law principles. You agree that any legal action or proceeding arising under or relating to these Terms or the Services shall be brought exclusively in the courts of competent jurisdiction located in the United States, and you hereby consent to the personal jurisdiction and venue of such courts.
We make no representation that the Services are appropriate or available in locations outside the United States. Those who choose to access the Services from outside the U.S. do so at their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
International Users: The Services are intended for United States users only. If you are accessing the Services from outside the U.S., be aware that your information may be transferred to, stored, and processed in the United States. By using the Services, you consent to such transfer and processing in the U.S., and you further agree that any disputes between you and Tripod Labs will be resolved under the laws and jurisdiction specified in this Section.
13. Changes to Terms
Tripod Labs reserves the right to modify or update these Terms at any time in our sole discretion. If we make material changes, we will notify users by posting the updated Terms on our website and/or through the mobile app, and by updating the “Effective Date” at the top of this document. In some cases, we may provide additional notice to you (such as via email or an in-app alert) of a revision to the Terms. It is your responsibility to review these Terms periodically for any changes.
All changes are effective immediately when posted, unless otherwise stated. By continuing to access or use the Services after updated Terms have been posted, you agree to be bound by the revised Terms. If you do not agree to any amendment of these Terms, you must stop using and delete your account/ the Services.
Please note that any revised Terms will supersede all previous versions. Except as expressly provided in this Section, no modification or alteration of these Terms by you (such as handwritten changes or oral statements) will be binding on Tripod Labs unless agreed in writing by an authorized representative of Tripod Labs.

Notices to You: We may provide you with notices regarding the Services, including changes to these Terms or other important updates, by email to the address associated with your account, by regular mail, or by postings within the website or mobile app. You agree that such electronic notices satisfy any legal requirement that communications be in writing.
15. Miscellaneous
Entire Agreement: These Terms (along with the incorporated Privacy Policy and any other policies or guidelines we provide within the Services) constitute the entire agreement between you and Tripod Labs regarding your use of the Services. They supersede all prior and contemporaneous understandings, agreements, representations, and warranties (both written and oral) regarding the Services.
Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect. Our failure to enforce any right or provision under these Terms will not constitute a waiver of that provision or any other provision.
Waiver: No waiver by Tripod Labs of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any waiver must be in writing and signed by an authorized representative of Tripod Labs to be effective.
Assignment: You may not assign or transfer these Terms (or any of your rights or obligations hereunder) without our prior written consent. We may assign these Terms, or any rights and obligations, to any successor, affiliate, or in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise. These Terms shall bind and inure to the benefit of the parties and their respective successors and permitted assigns.
No Third-Party Beneficiaries: These Terms are for the benefit of you and Tripod Labs (including our successors and assigns), and nothing herein gives any third party any rights or remedies under these Terms.
Headings: Section headings in these Terms are for convenience of reference only and have no legal or contractual effect.
By using the Tripod Labs website or mobile app, you acknowledge that you have read these Terms and Conditions, understand them, and agree to be legally bound by them.
